Below are some specific types of matters with which we are regularly involved.

Corporate and Commercial Disputes

We have diverse experience with business related cases for many clients with many issues. Examples are various contract disputes, corporate divorces, specific performance, unjust enrichment, reformation, warranty issues, enforcement of foreign judgments, fiduciary relationships, unfair business practices, and many more. Seldom are two business cases similar.

Commercial General Liability

We handle a myriad of general liability issues for companies and individuals. We regularly represent insurers, insureds, and self-insureds in matters of products liability, premises liability, and insurance coverage. Our products liability cases have involved food and beverages, ladders, bicycles, tires, gasoline tanks, motor vehicles, shock absorbers, cranes, etc. Our premises liability matters range from catastrophic industrial accidents to slip and fall cases.

Automotive and Commercial Transportation

We represent both defendants and plaintiffs in all kinds of cases involving motor vehicles. These range from simple car crashes, to crashworthiness, to complex issues involving motor carriers. Examples are logo liability, lease liability, trip leases, negligent entrustment, negligent hiring, negligent retention, driver fatigue, and indemnity–hold harmless agreements. We are frequently involved in supervising the investigation of accidents through our relationships with experts in accident reconstruction, human factors, and the like.

Property & Casualty

We handle significant numbers of commercial and personal lines property damage cases for insurers, insureds, and claimants. These include suspicious fires, hurricane and other storm damage, public nuisance, first-party bad faith, and casualty insurance coverage issues.

Real Estate Litigation

Our cases often involve real property in one way or another. We litigate title issues, interpretation of easements, real estate purchase/sale agreements, and restrictive covenants. We also handle condemnation and land use matters.

Insurance Coverage

We are directly involved in matters concerning insurance coverage. Many of our cases include allegations of bad faith handling by the insurer. We handle declaratory judgments to determine coverage issues. And, aside from litigation, we often render coverage opinions about claims arising from both occurrence and claims-made policies.

Intentional Torts

We routinely handle cases alleging intentional acts such as fraud, false imprisonment, false arrest, abuse of process, assault and battery, malicious prosecution, trespass, conversion, and intentional infliction of emotional distress.

Employment Discrimination and Other Employment Litigation

We have a range of experience with employment discrimination and other employee litigation. One area involves litigating restrictive covenants ancillary to employment agreements. We deal with issues concerning workplace safety, wrongful discharge, retaliatory discharge, and intentional interference with business or contractual relationships. We represent both employers and employees in litigating employment discrimination claims based on race, religion, gender, age, disability, etc. We have litigated other Title VII issues, especially sexual harassment.

Errors and Omissions–Professional Liability

We have litigation experience involving professional liability of doctors, lawyers, accountants, real estate professionals, and other professionals. This includes professional malpractice. We also handle directors’ and officers’ liability insurance, employee practices liability insurance, and real estate title insurance.

Construction

We have experience with issues concerning sureties, construction deficiencies, construction accounting, indemnity, Miller Act, delay damages, design errors, hazards abatement, and general contract disputes. We represent owners, general contractors, and subcontractors on surety and other issues on both private and public projects. We represent clients regarding both the enforcement and defense of materialman’s and mechanic’s liens.

Appeals

We regularly handle appeals in the federal and state courts for Georgia and Alabama.

Real Estate Transactions

We handle purchase and sale real estate closings for commercial and residential property. We also handle commercial and personal refinance closings. We provide title opinions and offer other services involving title work.
